These Terms of Service ("Terms") govern your access to and use of the AIAdKing website and software-as-a-service ("Service") operated by AIAdKing ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and authorised to bind your business. By using the Service you represent that you meet these requirements.
2. Account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorised use.
3. Marketplace authorisations
To use marketplace features (e.g. Amazon SP-API), you must authorise AIAdKing through the marketplace's official OAuth flow. You are responsible for ensuring you comply with the marketplace's own terms — including the Amazon Acceptable Use Policy and Data Protection Policy. You may revoke our access at any time from the marketplace.
4. Acceptable use
You may not (a) reverse engineer the Service, (b) use it to violate any law or any marketplace's terms, (c) interfere with the Service's operation, or (d) attempt to access another customer's data.
5. Fees
Paid plans (when available) are billed according to the plan you select. Fees are non-refundable except where required by law. We will give at least 30 days' notice before any price increase.
6. Intellectual property
The Service — excluding your data and marketplace data — is owned by AIAdKing and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
7. Your data
You retain all rights to data you upload or that we access on your behalf. You grant us a limited licence to host, process and transmit that data solely to provide and improve the Service, in accordance with our Privacy Policy.
8. Confidentiality
Each party will protect the other's confidential information using at least the same care it uses for its own confidential information of like importance, and not less than a reasonable standard of care.
9. Warranties and disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that any data returned by a marketplace API is accurate or complete.
10. Limitation of liability
To the maximum extent permitted by law, AIAdKing will not be liable for any indirect, incidental, special, consequential or punitive damages. Our aggregate liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.
11. Indemnity
You will indemnify AIAdKing against third-party claims arising from your unlawful or non-compliant use of the Service, or your breach of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination we will delete or return your data in accordance with our Privacy Policy.
13. Modifications
We may update these Terms from time to time. Material changes will be notified to registered users at least 14 days in advance. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the competent courts of India, except where mandatory law requires otherwise.
